Terms of Use

1. Purpose

These Terms of Use (“Terms”) govern access to and use of the KAPEX platform (the “Platform”), published by Gelios Investment & Partners Ltd within the Capital & Finance Cluster of the CEO Summit Indian Ocean.

The Platform's purpose is to connect, in strict confidence, project owners with qualified investors active in the Indian Ocean and Africa.

2. Acceptance

Registering on the Platform constitutes full acceptance of these Terms and of the Privacy Policy. Every user declares having read these documents and being legally capable of contracting.

3. Services

Submission of funding files by project owners;
Confidential introductions to investors of the CEO Summit network;
Activity tracking on each file (views, saves, expressions of interest);
Email and in-app notifications on the progress of each file;
Access to qualified deal flow for investor members of the network.

4. Confidentiality of files

No submitted file is made public on the Platform. Financial information, projections and sensitive data are shared only with investors previously approved by our team, and after the project owner's explicit consent.

5. User commitments

Users undertake to:

Provide accurate, up-to-date and verifiable information;
Not use the Platform for money laundering, tax fraud or illicit financing;
Respect the confidentiality of files accessed within their mandate;
Not solicit other users directly outside the process facilitated by our team.

6. Intellectual property

The Platform's content (excluding user files) is the exclusive property of Gelios Investment & Partners Ltd. Any unauthorised reproduction, distribution or exploitation is strictly prohibited.

Submitted files remain the property of their authors; the Platform is granted use solely for qualification and introduction purposes.

7. Limitation of liability

The Platform is neither an investment advisor nor a licensed financial intermediary within the meaning of applicable regulations. It exclusively facilitates introductions. No financial transaction is executed through the Platform, and nothing on the Platform constitutes an offer of subscription, investment advice or a recommendation. Any investment carries a risk of partial or total loss of capital and of illiquidity.

Investment decisions are the sole responsibility of the parties. CEO Summit IO and Gelios Investment & Partners Ltd accept no liability for the outcome of discussions, negotiations and agreements between users.

8. Termination

Users may delete their account at any time from the “Account & security” area. We reserve the right to suspend any account in case of breach of these Terms.

9. Changes to the Terms

These Terms may be amended at any time. Users will be notified by email and through the Platform of any substantial change. Continued use after notification constitutes acceptance.

10. Governing law and jurisdiction

These Terms are governed by Mauritian law. Any dispute falls under the exclusive jurisdiction of the courts of Port-Louis (Mauritius), unless mandatory law provides otherwise.
